“The right to strike is the most important means to lead collective bargaining at eye level.
An attack on this is an attack on our constitutionally guaranteed rights and also on the specific processes in our tariff movements. The demands of total metal would be an interference with the right to strike. This is already sufficiently designed by the case law of the Federal Constitution and Federal Labor Court. That must not and will not happen. Hands away from the right to strike!
There are also clear tariff rules for arbitration. It is our understanding of tariff autonomy that as a social partner, not the legislator, we regulate these processes. It is at least surprising that the understanding of tariff autonomy dies out at this point. ”
Nadine Boguslawski, IG Metall tariff officer:
“The right to strike is the most important right of employees. Any legal regulation of strike right is a gateway for further restrictions and tightening. Without the unrestricted right to strike, collective negotiations would only be collective begging. An unreserved right of strike means collective bargaining at eye level.
It is absurd if the overall metal praises the proven tariff arbitration procedure with us, but on the other hand prepares a legal regulation and restriction.
The independent judiciary can already decide whether strikes are proportionate or not. Therefore, the right must remain with constitutional rank. “
