MCALLEN, Texas, Aug. 20, 2025 /PRNewswire/ — The widow of Juan Nava Hernandez, an employee of Oak Texas Bar and Grill, has filed a wrongful death lawsuit in Hidalgo County District Court against Oak Texas Bar and Grill, LLC, and John Anthony Saenz.
Cynthia Rodriguez, left, the widow of Juan Nava Hernandez, right, has filed a wrongful death lawsuit in Hidalgo County District Court against Oak Texas Bar and Grill, LLC, and John Anthony Saenz. The lawsuit alleges that Mr. Nava, an employee of the bar, was killed in the parking lot by Mr. Saenz, a patron who had just left the bar after being over-served alcohol, despite being obviously intoxicated.
According to the complaint, on August 1, 2025, Nava was performing his duties as an employee of the bar, taking out the trash, when he was violently struck and killed in the parking lot by Saenz, a patron who had just left the bar after being over-served alcohol, despite being obviously intoxicated. Video evidence shows Saenz recklessly driving through the lot, running over Nava, and fatally crushing him against a cinderblock wall.
“This was not just a preventable tragedy – it was the killing of a hard-working employee doing his job,” said Attorney Alex Martinez of the Law Office of Alex Martinez, PLLC, who represents Mrs. Rodriguez, along with Attorney Ricardo A. Garcia of the Law Firm of Ricardo A. Garcia PLLC. “Juan Nava Hernandez showed up to work, and he never came home. The bar’s decision to keep serving alcohol to an intoxicated customer cost their own employee his life.”
Attorney Ricardo A. Garcia added: “Texas law makes it clear: bars cannot serve alcohol to obviously intoxicated patrons. Oak Texas Bar and Grill chose profits over safety, and one of their own workers paid the ultimate price. This case is about justice for Juan and his family and accountability for those responsible.”
The lawsuit seeks monetary relief over $1 million for wrongful death, negligence, gross negligence, and survival claims. Mrs. Rodriguez seeks damages for loss of financial support, loss of companionship, mental anguish, funeral and burial expenses, and exemplary damages to punish and deter such egregious conduct.
