The electric car manufacturer Tesla must not expect the price of his new model 3 cheaper by fictive cost savings. The advertising practice of Tesla had been “complained of misleading potential interested parties and violations of the price regulation”, announced the Center for Combating Unfair Competition on 6 March 2019, Tesla had settled out of court with the Wettbewerbszentrale and had to change its pricing until March 20, 2019.

The reason for the complaint: In the configuration of his Model 3 the prospective buyer is compared to the actual purchase price with a “price after savings”. Tesla deducts a lump sum of 5,000 euros and justifies this with an estimated savings in fuel costs over a period of five years. For example, the price of the “long-range battery” version is reduced from 53,280 euros to 48,280 euros. For a financing proposal, the monthly installment will be reduced by up to € 139 depending on the duration.

Saving “arbitrary” and “non-transparent”

However, according to the Wettbewerbszentrale, the stated savings are not only “ultimately arbitrary, but also intransparent and thus contradict the principles of price truth and price clarity”. In terms of fairness, such an amount can not be deducted from the purchase price or monthly installment to be paid by the customer, “because the customer must pay the full said price at the time of purchase or financing”. Such a price representation also violates the regulations of the Price Indication Regulation.

Tesla already had 2017 Anger with the Wettbewerbszentrale, At that time, the company had to undertake not to promote its model S 75 D with a “standard equipment” for a basic cash price of 69,019 euros, “if a vehicle for this price is actually not available”. For the same reason, the Federal Office of Economics and Export Control (BAFA) had Model S again deleted from the list of eligible electric cars,
