FrankfurtIn the dispute over compensation for the truck cartel, the Stuttgart Higher Regional Court (OLG) was the first to rule against the truck builder Daimler like. The applicant has, in substance, a claim for damages Daimler, said the Higher Regional Court on Thursday.
Undertakings are highly likely to create cartels that are priced higher than those achievable on the market. Thus the customers of the companies were probably also damaged. Daimler disagreed, arguing that only gross prices had been exchanged in the cartel, but not end-sale prices. The DaxCorporation announced that it was going to appeal the OLG ruling at the Federal Court of Justice.
In 2016, the EU Commission had Daimler’s cartel launched with the other truck manufacturers in the year before MAN, Volvo / Renault, DAF and Iveco fined € 3.8 billion. Hundreds of lawsuits are pending at regional courts.
The biggest one is joint claim for damages of more than 7000 transport companies Coordinated by the Federal Association of Road Haulage Logistics and Waste Management (BGL) with a claim of more than one billion euros at the district court of Munich.

The very first OLG verdict was in March in Dusseldorf. It went out in favor of the defendant manufacturer DAF. The Higher Regional Court Stuttgart negotiated the complaint of the construction company Matthäi from Verden, which requires as compensation for the purchase of several trucks at inflated price half a million euros in damages.
His legal representatives Ulrich Ide and Peter Gussone stated that the OLG ruling states that damage has occurred. The amount should be negotiated in a separate procedure. Daimler, on the other hand, considers that the question of whether there is any damage at all is also clarified in this further so-called amount procedure. But that is up to a BGH decision on hold.
