Last week the European Comission has published the new Vertical Agreement Exemption Regulation (MVBER), as well as its interpretative guidelines. From the point of view of competition, these rules regulate the agreements between suppliers and distributors in sectors such as the automotive industry,

faconauto is satisfied that the Commission has included in the new regulation and its guidelines some of the proposals that employers have been working on in the processing process, such as greater clarity in the compensation and remuneration system in the cases of agency models , as well as taking into account the changes that the sector is facing, such as the arrival of new players (digital platforms) or access to data held by dealers.

Faconauto hopes that this new regulation will allow manufacturers to offer dealers a clear and transparent framework to be able to face the transition process from a concession model to an agent model in which the sector is immersed. This should not be an impediment so that the rights and obligations of both parties are also defined in our country.

“The new European regulation is continuous, but the work we have done has borne fruit and the Commission has taken our proposals into account. It seems very important to us that, thanks to this, manufacturers can put clear proposals on the table for their dealers at this time of transition. We will continue working so that, also in Spanish legislation, fair rules of the game are established for dealers”, said the president of Faconauto, Gerardo Pérez.
