Previously, the German Environmental Aid (DUH) and the ZDF magazine “WISO” had accused the group, to use an illegal shut-off device for the emission control,

The reason for these values is, in particular, that exhaust gas recirculation is in some cases practically shut down under certain conditions, the DUH said.
BMW held against it, in the test of the environmental aid were deliberately atypical driving modes in the border area forced, in order to construct “plakative emission values”. The car maker announced that it would defend itself against “false reporting” by all available means. Whether the Munich legal proceed against the DUH, initially remained open. The BMW spokesman said only that the company is currently testing its options.
