BGH: Federal Court of Justice clarifies important questions in the VW diesel scandal

In the one case, the question is whether Volkswagen successful plaintiffs have to pay interest on the compensation owed for the time since the car was bought (Az. VI ZR 397/19) The other question is whether diesel owners can have claims against the company even if they only bought their car after the diesel scandal was exposed in autumn 2015 (Az. VI ZR 5/20). Whether a verdict will be announced on Tuesday is open.

The BGH already laid down the basic line in its first diesel judgment of May 25. It states that the Wolfsburg-based carmaker deliberately misled its customers and is therefore liable in principle. When calculating the amount of damages, plaintiffs must have the kilometers driven taken into account.
