Court proposes settlement How Daimler and Prevent could agree
Car seat of Mercedes-Benz: Prevent claims 40 million euros in damages
In the claim for compensation for the delivery of seat covers between the supplier Prevent and the carmaker Daimler, the Stuttgart Regional Court has proposed a settlement as announced. The judges suggested on Thursday that Daimler pays a good five million euros to Prevent and the supplier in return carries most of the court costs.
Whether the parties agree is open. You now have a good month to consider the proposal and make your decision. At the hearing, Daimler’s litigants emphasized that they were also asking questions of principle. (Az 11 O 32/17)
Prevent had demanded compensation of more than 40 million euros. The company had Daimler Show stock market chart by 2014 with seat covers and accuses the car maker, the supply contract to have ended unlawfully, shortly after new terms had been agreed. Daimler in turn accuses the supplier of having forced the new conditions with an illegal threat of a delivery stop.

In its settlement proposal, the court reiterated on Thursday that it could not understand the amount of alleged damage. It is therefore still unclear whether there was a delivery obligation for Prevent at all – because only then would the announcement of a delivery stop be regarded as an unlawful threat at all. Should the procedure not be ended by comparison, these questions would have to be clarified.
