German FAZ: Forbidden TV advertising from the Habeck Ministry 008694

A total of 13 private television stations violated media law with the broadcast of the “Energy Change” spot of the Federal Ministry of Economics and Climate Protection (BMWK) at the end of 2023. The state media institutions had classified this spot as political advertising because it was “not informed neutral”, a spokeswoman said. The spot “specifically for the energy policy measures” of the Ministry of Economic Affairs. Political, ideological or religious nature, ”said the spokeswoman. Therefore, the Commission for Admission and Supervision (ZAK) objected to this. The spot was not “a contribution to the public service”. Such contributions are permitted according to the Media State Treaty. The Ministry of Economic Affairs does not see any political advertising in the spot and refers to a judgment of the Federal Constitutional Court of 1977. This underlined the importance of state public relations. The ministry fulfills its obligation to provide information.
