The prison sentence of one year and three months against the highest-ranking defendant, the former VW development board, Heinz-Jakob Neusser, is also suspended. On Monday afternoon, the defense announced that he wanted to appeal. The defendants had always denied the allegations in the procedure. Many false and incomplete witness -to -say judges Christian Schütz spoke of an “extraordinarily complex and extensive taking of evidence” that the court had to do. Many of the witnesses surveyed were involved in the manipulations in question, and some were exposed to criminal allegations. This led to the fact that many statements had been incomplete or would not have met the truth. There were two operating modes in the affected vehicles, one for exhaust gas measurement on the roller test bench and one for the actual use on the street. Only the lower data from the test mode were shown to the authorities, but the actual emissions were kept silent. “It is obvious that this did not meet the legal requirements,” said Schütz.
