Ten years of proceedings, over 800,000 euros in court and expert costs- and an on-site appointment high up in the Peruvian Andes. The process, which ended on Wednesday in front of the Hamm OLG, was exceptional in many ways. Legally, the question was whether the Essen energy giant RWE was at risk of protecting Peruvian Andenbauer Saúl Luciano Lliuya through his contribution to climate change and must therefore pay for protective measures. On Wednesday, the judges dismissed the lawsuit. The legal dispute has ended – the OLG has not approved the revision for the BGH. However, the discussion about the scope of the decision has only started.
