On Tuesday, the Federal Court of Justice (BGH) declared a decision of the Volkswagen general meeting from 2021 null and void. This decision was the basis for a cover comparison with a number of manager liability insurers over a payment of 270 million euros. The second civilians in Karlsruhe decided that the group had not sufficiently informed the shareholders of the agenda that this would be associated with a waiver of claims against all other board members. In addition, the Celle Higher Regional Court has to deal with former top managers again. Martin Winterkorn, the former CEO in Wolfsburg, paid 11.2 million euros and the former Audi boss Stadler 4.1 million euros. In Dieselskandal, Volkswagen should receive compensation of 288 million euros after comparing with previous board members such as Martin Winterkorn and Rupert Stadler, as well as a number of manager liability insurers (D&O). Is the group still entitled to the money according to the current decision of the Federal Court of Justice?
